Pepperidge Farm has withdrawn its lawsuit against Trader Joe’s for alleged mimicking of its Milano cookie brand’s format and packaging, with each party bearing its own cost. 

The dismissal was approved by the US district judge for the district of Connecticut, Alvin Thompson, on March 9. 

ConfectioneryNews previously reported Campbell Soup-owned Pepperidge Farm​ launched trademark infringement action against the retailer last December.

Ira Levy, a New York lawyer who represents Pepperidge Farm said: “The case between Pepperidge Farm and Trader Joe’s was settled on mutually agreeable terms.”​ However, he refused to comment on what prompted the cookie company to dismiss the case in the first place.

Trader Joe’s spokesperson, Allison Mochizuki, said the retailer will not comment on the litigation.

Campbell Soup Company’s senior manager of external communications, Tom Hushen, said the trust Pepperidge Farm has built with consumers is of utmost importance to the company.

Even though Pepperidge Farm has reached a mutually satisfactory resolution, Hushen said, We enforce and defend our valuable trademark rights and we want consumers to be sure of the source of their products”.

No confusion was possible

There is no way anyone could have confused the TJ cookies for the vastly inferior product made by Pepperidge Farm.
